These terms govern access to Banizzo's public website, hosted commerce platform, administration tools, and related support services. By creating an account, signing an order form, or using the service, you agree to these terms and the applicable order form.
Service and merchant responsibilities
Banizzo provides software for operating an online store. Each merchant remains the seller of record for its products and is responsible for product accuracy, lawful trading, taxes, invoices, customer support, fulfilment, cancellation, returns, refunds, and its own storefront policies. Banizzo is not a party to a purchase between a merchant and shopper.
Accounts and security
Account information must be accurate and current. Users must protect credentials, enable available security controls, grant staff only the permissions they need, and promptly report suspected compromise. Activity performed through an authorised account is the merchant's responsibility unless caused by Banizzo's breach of its obligations.
Plans, charges, cancellation, and refunds
Plan limits, fees, billing periods, taxes, renewal terms, and any trial are defined in the accepted order form or checkout. Third-party domain, courier, messaging, and payment charges may be separate. A merchant may request cancellation through its agreed support channel. Refund eligibility is governed by the order form and mandatory law. Nothing here limits a non-waivable consumer right.
Merchant and customer data
Merchants retain ownership of their content and business data and grant Banizzo the limited right to host, process, transmit, and back it up to provide and secure the service. Merchants must have a lawful basis for customer data they collect and publish accurate storefront privacy and trading policies. Banizzo's handling of platform data is described in the Privacy Policy.
Third-party services
Integrations with payment gateways, couriers, domain providers, analytics, email, and messaging services are subject to their own approval, availability, fees, and terms. A merchant authorises Banizzo to exchange the minimum required data with integrations it enables. Banizzo does not control a provider's service or settlement decisions.
Acceptable use
You may not use the service for unlawful, fraudulent, deceptive, infringing, or abusive activity; introduce malware; probe another tenant; bypass access controls or quotas; scrape protected areas; or disrupt the platform. Banizzo may restrict affected functionality while investigating a credible security, legal, payment, or abuse risk.
Availability and changes
Banizzo aims to operate the service reliably, but maintenance, provider failures, security events, and circumstances outside reasonable control may interrupt it. Material changes to these terms will be posted with a new effective date and, where appropriate, notified through the service before taking effect.
Intellectual property
Banizzo and its licensors retain rights in the platform, software, documentation, brands, and underlying technology. The subscription grants a limited, non-exclusive, non-transferable right to use the service during the active term; it does not transfer ownership.
Liability
To the maximum extent permitted by applicable law, neither party is liable for indirect, consequential, or special loss. Aggregate contractual liability is limited to fees paid for the affected service during the twelve months before the event, except where liability cannot lawfully be limited or results from fraud, wilful misconduct, confidentiality breach, or infringement.
